Whether owing payroll taxes is a criminal matter will generally be determined by all of the facts and circumstances of the matter. Many businesses fall behind and end up owing payroll taxes to the IRS and it remains a civil matter before the government. That being said, if the business owner or owners are living off of not paying the company’s employment taxes and the matter continues for a period of time with a substantial amount of payroll taxes being due, the government could consider criminal prosecution.
